DESIGN SERVICES FEE AGREEMENT

 

            This document (the “agreement”) is the written fee agreement between Tiffany Lee Ann Designs and the end user for the custom Home Style Kit design services. 

            (1)       CONDITIONS.  This agreement will not take effect, and we will have no obligation to provide design services, until you checked box and agreed to this agreement and pay the custom design fee called for under Paragraph 4.

            (2)       SCOPE OF SERVICES.  You are hiring this office as designer.  The scope of services covered by your retainer includes floor plans, design boards, finish and furnishing selections, and a shopping guide or resources.

Your retainer does not include us doing any labor, installation, or construction work.  Our aim is to complete this project within 10 business days. 

Any services provided outside of those listed above shall be billed at $100.00/hr. in quarter hour increments. 

            (3)       CLIENT’S DUTIES.  You agree to cooperate, to keep us informed of developments, to abide by this agreement, to pay your bills on time and to respond to our communication in a timely manner.

            (4)         Flat fee of $499.00 per room, which is non-refundable for a Home Style Kit Design Guide which will be sent digitally.  All payments by credit cards (Visa, MasterCard, American Express, Discover) shall incur a 3% fee for each transaction.  

            (5)       DELAY IN PAYMENT AS EXCUSING SERVICES.  If any of our bills remains unpaid for more than 5 calendar days after they are sent out, we shall have the right to discontinue rendering further services to you in connection with any matter then being handled for you by us, until the amount of such billing is paid in full.

            (6)       REFUNDS AND COSTS.  There are absolutely NO REFUNDS OR CREDIT for custom made products or materials.  Some products that are not custom made may not be refundable as well but you will be informed of that prior to placing an order.  There is a twenty-five percent (25%) restocking fee for non-custom made products that are refundable.  All costs for purchases, labor, and materials shall be paid in full prior to their incurment.   

            (7)       BILLING STATEMENTS. If you choose to hire us hourly beyond the Custom Home Style Kit, we will send you periodic statements for fees and costs incurred.  Each statement will be due within 5 calendar days of its date.  You may request a statement at intervals of no less than 30 days.  If you do, we will provide one within 5 calendar days.

            (8)       DISCHARGE AND WITHDRAWAL.  You may discharge us at any time and we may terminate our services at any time.

            When our services conclude, all unpaid charges will immediately become due and payable.  After our services conclude, we will, upon your request, deliver your file to you, along with any funds or property of yours in our possession.

            (9)       DISCLAIMER OF GUARANTEE.  Nothing in this agreement and nothing in our statement to you will be construed as a promise or guarantee about any product, material, vendor, manufacturer, or contactor.  We make no such promises or guarantees.  Our suggestions or recommendations are expressions of opinions only. 

            (10)     EFFECTIVE DATE.  This agreement will take effect when you have performed the conditions stated in paragraph 1, but its effective date will be retroactive to the date we first performed services.  The date at the beginning of this agreement is for reference only.  Even if this agreement does not effect, you will be obligated to pay us the reasonable value of any services we may have performed for you.
